Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Nuvocode Technologies, LLC (“we”, “our”, or “us”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Nuvocode Technologies, LLC provides web and mobile application development services, including but not limited to:

  • Web application development
  • Mobile application development
  • AI/ML development and integrations
  • API development
  • DevOps support
  • Cloud management

All service plans specify a maximum number of hours of work per month. Accrual of unused hours is permitted up to three times the maximum hours specified in the service plan. Any hours worked in excess of the maximum will be billed at the rate specified in the service plan. Accrued hours are not redeemable outside regular support hours of 9am-5pm US Central Time. Support requests for hours outside of regular support hours will be billed at the off-hours rate specified in the service plan.

Termination of a service plan can be done at any time by contacting us at support@nuvocode.com. Requests must be made within 5 business day before excution of the next billing cycle; for notifications of termination made less than 5 business days before the next billing cycle, we will make every reasonable effort to honor the request, however successful termination cannot be guaranteed in which case you will be charged for the next billing cycle and terminated thereafter.

We reserve the right to terminate a service plan at any time for any reason. In the case of a termination initiated by us, you will receive a refund for the unused portion of the current billing cycle on a prorated basis.

3. User Responsibilities

As a user of our services, you agree to:

  • Provide accurate and complete information when signing up for services
  • Use our services in compliance with all applicable laws and regulations
  • Not attempt to gain unauthorized access to our systems or networks
  • Not use our services to transmit any harmful code or engage in any malicious activities

4. Intellectual Property

All content, features, and functionality of our services are owned by Nuvocode Technologies, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5. Payment and Billing

Payment for our service plan are as follows:

  • Fees are as indicated on our Pricing page.
  • You agree to pay all fees in accordance with the payment terms in effect when a fee is due and payable.
  • If your payment method fails or your account is past due, we reserve the right to terminate your service plan at any time past the billing due date.

Payment for one-off projects and support are as follows:

  • We require a 20% deposit to begin work on a project.
  • The remaining balance is due upon completion of the project and must be received in full within 10 business days of the completion date.
  • Assets and ownership of the project are transferred to you upon receipt of the final payment.
  • If you need to cancel the project, you will be charged for the hours worked up to that point, minus the received deposit amount.
  • If you cancel the project and the value of hours worked is less than the received deposit amount, you will be refunded the difference within 10 business days of the cancellation date.
